Perc Test: It should be noted that Hemingway Land does not get perc tests performed on the properties we sell either prior to taking title or during the time we own them. Given this property’s location in a residential subdivision with a number of developed home sites near by, we believe it reasonable to expect the land to pass any perc test performed on it in the future. Anyone interested in purchasing this property who is concerned about such things can request the eventual sale/purchase agreement be made contingent on the results of such a test. Meaning, if paying the full price for the land and closing through a title company, the $500 non-refundable earnest money deposit would be refunded if, during the escrow period, a perc test revealed that the land failed to perc. Similar arrangements could also be made with buyers electing to purchase on terms or with owner financing.
No HOA: The Hacienda San Juan subdivision does not have a formal HOA nor are there are any annual dues associated with land ownership here. In addition, there are no covenants or restrictions governing the land in this region which should provide potential buyers with even greater freedom and independence to develop the property however they please.
Zoning: While the subject property may be without subdivision restrictions, Apache County is not without zoning. This particular region is zoned Agricultural General, a provision which “provides for the continuation of agricultural, recreational, limited residential…and other land uses that are consistent with rural land areas.” This provision of course allows for the construction and use of single family residences, mobile and modular homes, but it also allows for the breeding, raising and training of certain livestock, including horses, cattle, sheep and goats. As noted, the subject property sits just a few minutes west of St. Johns, the county seat of Apache County.
